TERMS & CONDITIONS

1. About Gildex

Gildex Gold Buyers Pty Ltd (ABN 53 688 366 467) trading as Gildex and Gildex Gold Buyers (“Gildex”, “we”, “our”, “us”) is a licensed second-hand dealer operating from Level 7, Suite 12, 55 Gawler Place, Adelaide SA 5000.

These Terms & Conditions apply to all services including in-store appointments, mail-in services, online tools, estimator systems, website use, and any related transactions.

By using our services, you agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

To use our services, you must:
• be at least 18 years of age;
• be the lawful owner of all items submitted or have legal authority to sell them;
• provide valid government-issued photo identification when required;
• provide accurate and complete information at all times.

3. Our Services

We provide the following services:
• in-store buying appointments;
• mail-in buying services;
• online estimator tools;
• estate and bulk purchasing services;
• wholesale and trade purchasing services.

We may modify, suspend, or discontinue any service at any time.

4. In-Store Appointments

At in-store appointments, items may be:
• tested and weighed;
• assessed and authenticated;
• photographed for internal records;
• offered for purchase.

If an offer is accepted, payment is generally made by bank transfer on the same business day.

5. Mail-In Service

5.1 Process

Customers requesting mail-in services will receive a prepaid Australia Post satchel.

Customers must:
• complete the Item Declaration Form;
• securely package items;
• lodge the parcel using Australia Post;
• retain tracking and proof of lodgement.

Upon receipt, items are opened under recorded intake procedures and assessed.

A written offer is generally issued within 24 hours of receipt.

If accepted:
• payment is made by bank transfer;
• ownership transfers immediately upon confirmed acceptance of payment.

If declined:
• items are returned using an approved tracked shipping method.

5.2 Transit Cover & Shipping

Mail-in parcels may be covered for transit loss up to $15,000 per parcel under Gildex’s insurance arrangements when sent using approved shipping methods.

Transit cover applies only where:
• the supplied satchel and approved postage method are used;
• the parcel is lodged and scanned by Australia Post;
• valid tracking and proof of lodgement are retained;
• the parcel complies with Australia Post and Gildex instructions.

Transit cover is conditional and subject to insurer terms, exclusions, and the applicable service used.

Higher-value parcels may require prior written approval before dispatch.

All descriptions, photos, or estimates provided before physical inspection are indicative only and do not constitute a valuation or insured value.

5.3 Damaged or Tampered Parcels

If a parcel arrives damaged, opened, or tampered with, Gildex may:
• photograph and video record the parcel;
• document the unpacking process;
• retain packaging for investigation;
• report to carriers or insurers where required.

6. Online Estimator Tools

All pricing tools and calculators are indicative only.

They:
• do not constitute a binding offer;
• may rely on third-party pricing data;
• may change without notice.

Final offers are only made after physical inspection and testing.

7. Testing & Valuation

Items may be assessed using:
• XRF metal analysis;
• gemstone and diamond testing;
• visual and gemological inspection;
• calibrated weighing;
• authenticity verification.

Valuations are based on:
• metal purity and weight;
• gemstone quality and authenticity;
• prevailing market prices;
• wholesale and resale conditions.

Customer descriptions are for identification only and are not guarantees of value or authenticity.

8. Offers & Acceptance

All offers are:
• made in writing;
• valid for 24 hours unless stated otherwise.

Acceptance of an offer constitutes a final and binding sale.

Ownership transfers immediately upon confirmed acceptance of payment.

No cooling-off period applies.

9. Mandatory Holding Period

Purchased items may be subject to a statutory holding period under the Second-hand Dealers and Pawnbrokers Act 1996 (SA).

This requirement:
• is for regulatory purposes only;
• does not affect sale finality;
• does not allow reversal of the transaction.

10. Payment

Payments are made by bank transfer only.

Payments are generally processed within 24 hours of acceptance and verification.

Customers are responsible for providing correct banking details.

We are not responsible for delays caused by financial institutions or incorrect information supplied by the customer.

11. Returns

If an offer is declined:
• mail-in items are returned within 2–4 business days;
• returns are sent via tracked shipping methods.

Items not purchased in-store are returned immediately.

12. Photography & Content Use

We may photograph or film items for:
• internal records;
• security and compliance;
• marketing and social media content.

We do not publicly identify customers unless explicit written consent is provided.

Operational and compliance recording may still occur.

13. Licensing & Compliance

We operate under:
• Second-hand Dealers and Pawnbrokers Act 1996 (SA);
• Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth);
• Australian Consumer Law.

Customers warrant that submitted items:
• are legally owned;
• are not stolen or disputed;
• are not subject to encumbrance.

We may refuse service or report matters where legally required.

We handle personal information in accordance with our Privacy Policy.

14. Liability

To the maximum extent permitted by law, we are not liable for:
• postal or courier delays;
• banking delays or errors;
• third-party service failures;
• estimator inaccuracies;
• market fluctuations;
• indirect or consequential loss.

Our liability is limited to the applicable transaction value or insured transit cover, where relevant.

Nothing in these Terms excludes rights under Australian Consumer Law that cannot be excluded.

15. Customer Warranties & Indemnity

You warrant that:
• you are legally entitled to sell submitted items;
• all information provided is accurate;
• items are not counterfeit or unlawfully obtained.

You agree to indemnify Gildex against claims arising from:
• misrepresentation;
• ownership disputes;
• breach of these Terms.

16. Privacy

Your use of our services is subject to our Privacy Policy.

We collect and handle personal information in accordance with Australian privacy laws.

If there is any inconsistency between these Terms and the Privacy Policy, these Terms prevail to the extent of inconsistency.

17. Dispute Resolution

We encourage resolution of disputes in good faith.

If unresolved, disputes may be referred to mediation or independent arbitration.

These Terms are governed by the laws of South Australia.

18. Website & Intellectual Property

All website content, branding, tools, images, and materials remain the property of Gildex unless otherwise stated.

They may not be copied or reproduced without written consent.

We do not guarantee uninterrupted website or tool availability.

19. General

We reserve the right to refuse service at our discretion.

These Terms constitute the entire agreement between you and Gildex.

If any provision is found unenforceable, the remaining provisions remain valid.

We may update these Terms at any time by publishing changes on our website. Continued use of our services constitutes acceptance of updates.
